By accessing or using Nexaforge, you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users, including Customers, Taskmasters, and visitors.

If you do not agree to these Terms, please do not access or use the platform.

You must be at least 18 years old to use Nexaforge.

Individuals under 18 may only use the platform with the supervision and consent of a parent or legal guardian where permitted by applicable law.

You are responsible for maintaining your account and keeping it secure:

• Users are responsible for keeping login credentials secure and confidential.
• Users must provide accurate, current, and complete information during registration.
• One person may not create multiple fraudulent accounts.
• Users are responsible for all activities that occur under their account.
• Notify Nexaforge immediately if you suspect unauthorized access to your account.

To help maintain a safe and trusted marketplace, some users may be asked to verify their identity.

Identity verification improves trust between Customers and Taskmasters and helps prevent fraud.

• Verification documents are encrypted during transmission and storage.
• Documents are never shared publicly on your profile.
• Documents are never sold, rented, or distributed to third parties.
• Verification is used solely for identity confirmation, fraud prevention, and legal compliance.

All users of Nexaforge are expected to:

• Provide accurate and truthful information at all times.
• Use the platform lawfully and ethically.
• Maintain the confidentiality of account credentials.
• Not use the platform for any illegal, harmful, or fraudulent activities.
• Comply with all applicable Philippine laws and regulations.
• Treat other users with respect and professionalism.

Taskmasters using Nexaforge must:

• Provide accurate service descriptions and fair pricing.
• Represent skills, qualifications, and experience truthfully.
• Complete accepted tasks in a professional and timely manner.
• Meet the agreed-upon scope, quality, and timeline.
• Maintain professional communication with Customers.
• Comply with all platform policies and applicable laws.

Customers using Nexaforge must:

• Provide clear, accurate task descriptions.
• Set a reasonable scope for the agreed budget and timeline.
• Make timely payments through the platform's secure payment system.
• Communicate expectations clearly with the Taskmaster.
• Review completed work honestly and fairly.

The booking flow on Nexaforge is designed to be simple, transparent, and secure for both Customers and Taskmasters:

• Customer submits a service request.
• Taskmaster reviews and accepts the request.
• Booking is confirmed and payment is secured.
• Taskmaster completes the service.
• Customer confirms completion.
• Payment is released to the Taskmaster.

Nexaforge is committed to being fair to Taskmasters and transparent with Customers.

For Taskmasters: 0% commission. You keep 100% of your listed service rate. Whatever rate you set — Hourly, Per Task, or Per Day — is exactly what you receive.

For Clients: a service fee of up to 10% is added at checkout, on top of the Taskmaster's rate. This fee never reduces what the Taskmaster is paid.

• Payment processing (approximately 2.5–3.5%) goes directly to our regulated payment processor.
• The platform fee funds Nexaforge operations: secure messaging, dispute support, identity verification, and platform improvements.
• Any withdrawal fees, if applicable, will always be disclosed before confirmation.
• Payments are processed through trusted, regulated payment providers.
• No hidden deductions — all fees are shown upfront.

Both Customers and Taskmasters may need to cancel a booking under certain circumstances. The following guidelines apply:

Reviews help build trust and maintain quality on the platform. The following guidelines apply:

• Reviews must be honest and based on genuine experiences.
• Fake reviews are strictly prohibited.
• Review manipulation — including offering incentives for positive reviews — is not allowed.
• Nexaforge may remove reviews that are abusive, fraudulent, or violate platform policies.
• Both Customers and Taskmasters can leave reviews after a completed booking.

The following activities are strictly prohibited on Nexaforge:

• Fraud, scams, or deceptive practices
• Identity theft or impersonation
• Harassment, threats, or intimidation
• Discrimination based on race, gender, religion, age, or any protected characteristic
• Spam or unsolicited messaging
• Money laundering or financial crimes
• Posting illegal services or content
• Circumventing platform payments (e.g., paying directly outside the platform)
• Sharing malware, viruses, or harmful code
• Creating fake or fraudulent accounts
• Selling stolen or illegally obtained property
• Using bots or automated systems to manipulate rankings or reviews
• Using the platform for any unlawful purpose

All Nexaforge logos, brand names, designs, website content, software, and AI systems remain the intellectual property of Nexaforge.

Users retain ownership of the content they upload to the platform.

By uploading content, users grant Nexaforge a limited, non-exclusive license to display that content for the purpose of operating the marketplace.

Your personal information is handled in accordance with our Privacy Policy and the Philippine Data Privacy Act of 2012 (Republic Act No. 10173).

We implement appropriate administrative, technical, and organizational safeguards to protect your data.

Nexa is an AI-powered virtual assistant available throughout the platform to help users find services, understand platform features, answer frequently asked questions, navigate the website, and connect users with support when needed.

• AI responses are generated automatically and, while intended to be accurate and helpful, may occasionally be incomplete or incorrect.
• Users should not rely solely on AI responses for legal, financial, or emergency decisions.
• If the AI cannot resolve an issue, users can contact human customer support directly through the built-in support form or live chat.
• Nexa AI automatically responds in the user's selected language.
• Translations are generated using the Google Cloud Translation API and translated sentence-by-sentence to preserve natural grammar, context, and meaning.
• Legal terminology, product names, URLs, email addresses, and the Nexaforge brand are always preserved without translation.

Nexaforge strives to maintain a reliable and available platform. However:

• Scheduled maintenance may temporarily affect availability.
• Unexpected outages may occur due to technical issues.
• Platform updates may introduce changes or temporary disruptions.
• Nexaforge does not guarantee uninterrupted service and is not liable for downtime beyond its reasonable control.

Nexaforge may suspend or terminate accounts involved in:

• Fraud or deceptive practices
• Abuse or harassment of other users
• Illegal activity
• Repeated policy violations
• Circumventing platform payments

Users may delete their accounts at any time through their account settings.

Nexaforge facilitates connections between Customers and independent Taskmasters. We are not an employer and do not guarantee the outcome of any service.

To the fullest extent permitted by law, Nexaforge shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Services.

Nexaforge is not responsible for the conduct, performance, or quality of services provided by Taskmasters.

You agree to indemnify and hold harmless Nexaforge and its affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

• Your misuse of the platform
• Your breach of these Terms
• Your violation of applicable laws or third-party rights
• Any content you submit or transmit through the platform

Nexaforge shall not be responsible for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to:

• Natural disasters
• Pandemics or public health emergencies
• Government actions or regulations
• Internet or telecommunications outages
• Cyberattacks or security breaches
• Other unforeseen events beyond reasonable control

Nexaforge shall not be liable for any such delays or failures.

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms shall be subject to the jurisdiction of the appropriate courts in the Philippines.

Any disputes arising from these Terms or the use of our Services shall first be addressed through good-faith negotiation between the parties.

If the dispute cannot be resolved through negotiation, it shall be settled through binding arbitration in accordance with applicable laws in the Philippines.

Nexaforge may update or modify these Terms at any time. Material changes may be communicated through:

• Email notifications
• Website notices
• In-app notifications

Continued use of Nexaforge after changes are posted constitutes your acceptance of the revised Terms.
